Terms of Service

1. Service Description

Murmure is a consumer subscription service that generates personalised, audio bedtime stories for children based on parent-provided preferences and daily highlights. The service is available via web and mobile apps.

Story generation is powered by AI models and text-to-speech technology. While we aim for consistently high quality, generated content may vary and we do not guarantee specific story outcomes or outcomes for your child's sleep.

2. Accounts

• You must be 18 years or older to create an account. Murmure is designed for parents and guardians — children do not create accounts and do not interact with the service directly.
• You are responsible for maintaining the security of your account credentials and for all activity under your account.
• You may create profiles for up to the number of children permitted by your plan. Profile data (first name, age) is used solely to personalise stories.
• You may delete your account at any time from the app settings. Upon deletion, all account data, children's profiles, and stored stories will be permanently removed.

3. Free Trial and Subscription

Free trial

New accounts receive 3 free stories, including access to the premium whispered voice. No credit card is required for the trial. After the trial, continued use requires a paid subscription.

Subscription plans

Current plans are published on our pricing page. Indicative plans at the time of writing:

• Murmure Premium — €18/month. A new personalised story every night, whispered narration, all vibes & companions, 1-click Yoto send.
• Annual — €150/year (€12.50/month). Everything in Premium, billed once a year.

All prices are in EUR and exclusive of applicable taxes (TVA). Taxes are applied at the applicable rate where required by law.

Billing

• Subscriptions are billed in advance on a monthly or annual cycle from the date of activation.
• Payment is processed securely by Stripe, Inc. We do not store your card number.
• If a payment fails, we will retry up to three times over 7 days. Access may be suspended until payment is settled.
• We may adjust pricing with 30 days' written notice. Continued use after the notice period constitutes acceptance of the new price.

4. Cancellation and Refunds

You may cancel your subscription at any time from the app settings or by emailing hello@kamina.io. Cancellation takes effect at the end of the current billing period — you retain access until then.

We do not offer refunds for the current billing period upon cancellation. If you experience a technical failure that prevented you from using the service, contact us and we will consider a credit on a case-by-case basis.

EU consumer right of withdrawal: If you are a consumer resident in the EU, you have a statutory 14-day right of withdrawal from the date of your first subscription payment. By requesting that we begin providing the service before the end of that period (i.e., by starting to generate stories), you acknowledge that you consent to early service delivery and that your right of withdrawal is lost once the service has been fully performed. For partial performance, a pro-rata refund may apply.

5. Acceptable Use

You agree not to use Murmure to:

• Generate content that is illegal, harmful, abusive, or that violates any applicable law or regulation.
• Attempt to reverse-engineer, scrape, or systematically extract content or data from the service.
• Share account credentials or resell access to the service.
• Submit false or misleading information to generate stories.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

6. Intellectual Property

The Murmure platform, brand, and underlying technology are owned by Kamina.io (SASU). The generated stories and audio created for your account are provided to you for personal, non-commercial use within your household.

You retain ownership of the specific highlights and preferences you provide. You grant us a limited licence to process that data solely to generate your stories.

7. Disclaimers and Limitation of Liability

Murmure is provided "as is". We do not guarantee that:

• The service will be uninterrupted or error-free.
• Generated stories will meet your specific expectations in every instance.
• Use of the service will result in any particular outcome for your child.

To the maximum extent permitted by applicable law, Kamina.io's total aggregate liability shall not exceed the total subscription fees you paid in the 3 months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded under French law.

8. Governing Law and Jurisdiction

These Terms are governed by French law, without regard to conflict of law provisions. Any dispute shall first be subject to a 30-day amicable resolution attempt. If unresolved, both parties submit to the exclusive jurisdiction of the Tribunal de Commerce de Metz.

If you are a consumer resident in the European Union, mandatory consumer protection provisions of the law of your country of residence continue to apply.

9. General Provisions

• Amendments: We may update these Terms with at least 30 days' notice for material changes. Continued use after the effective date constitutes acceptance.
• Severability: If any provision is found invalid, it shall be modified to the minimum extent necessary, and the rest remains in force.
• Entire agreement: These Terms constitute the entire agreement between you and Kamina.io regarding Murmure.
